Pre Conference Session - Risk Management 101
(Free) Risk means different things to different people. Some are risk averse while others are risk takers. Some campus departments see an issue as a risk to their activities while others see the same issue as a benefit.

Risk Management 101: Practical Application for Higher Education, a FREE four-hour long session, will provide participants with an opportunity to explore what risk looks like for them, as well as have the opportunity to compare and contrast those ideas with their constituents at other institutions. Experienced higher education risk managers will facilitate discussion on how you can utilize this information to begin developing a risk management plan for your school.

This workshop will explore how attendees can make risk management "real” for others on their campus by utilizing formal risk management processes to identify, mitigate and respond to potential exposures. Participants will be given the opportunity to network with their colleagues to discuss concerns, strategies, roadblocks and navigational tools that will allow them to begin important conversations on their campuses.

The workshop is geared toward professionals new to risk management and those new to higher education. Participants will have a chance to meet their new colleagues in a smaller setting before the conference. New members and first time conference attendees will also be invited to join us for the President's Reception later that evening.

Data Breach Preparedness & The Threats to Higher Education
Institutions of Higher Education collect a great deal of information on potential applicants, matriculated students and their families, and alumni and there is a legitimate business purpose to keep this information for an alumni’s entire life and even longer in many cases. There is a great benefit to having as much information as possible on students and alumni but with this information comes significant liability. This session will help risk managers understand the unique threats that institutions face and the regulatory requirements that dictate how institutions need to respond in the event that information is compromised. Given the increased scrutiny from boards and media and the immense costs associated with the response and potential litigation we will help attendees understand what can be done to prepare for the inevitable data breach to manage costs and make sure that the process is as efficient as possible. We will also discuss some of the intricacies of the cyber liability insurance marketplace providing attendees with some tips to consider when purchasing and negotiating a cyber liability program.

Topics to cover: Cyber crime threat matrix for higher education institutions, overview of the regulatory environment, data breach preparedness tips, and a discussion about important considerations when purchasing and negotiating a cyber liability program.

Who should benefit: Risk Managers will benefit from a program like this by gaining a deeper understanding of the environment around data breaches and how they can make their institutions more attractive risks by managing and transferring this exposure off of their balance sheets.

How can risk managers and risk assessment techniques be used to improve export control administration on your campus? In this workshop, the presenters share their experience working together in assessing export control risk. Greek Organizations On Campus
Greek organizations provide students with strong social ties and philanthropic opportunities. Yet, despite these advantages, a number of colleges and universities are re-evaluating their relationships with Greek organizations, particularly fraternities. In spring 2015, 133 Greek chapters were shut down, suspended, or otherwise punished after alleged offenses. For colleges and universities that seek to retain the tradition of Greek life, a sound risk management program is essential to protect students from harm and to safeguard the institution, its officers, and its assets. Staying on the Path: Avoiding Coercive Risks and Propriety Loss to Scholars Traveling Abroad
Higher education has not adequately addressed the risk to students, faculty and staff that is posed by coercive activities undertaken by corporate and foreign government intelligence services. Many campuses have projects and experts that are of great interest to foreign governments, industrial saboteurs, and outside faculty who may attempt to obtain and exploit ongoing research and development without regard for professional propriety or public law. Students and scholars unwittingly may come into contact with those acting on behalf of foreign commercial and government interests as they travel abroad. What steps should risk and security professionals take to educate our international travelers and prevent the loss of intellectual property? Join four experts in international health and safety with varying connections to the intelligence community to consider the following questions (and more): What puts your campus and its travelers at risk? How is intelligence gathered? Who is a target? Where should you be wary? This interactive workshop will increase shared knowledge and offer increased capacity to promote compliance with existing contracts and legislation. It will help you establish processes to identify and inhibit outsiders from stealing this intellectual property, which may result in lost federal funding and/or violating contract terms with corporate partners. Our students and scholars make great personal and institutional investments into the development of knowledge and its translation to increased capacity. As risk and security professionals, we are charged with taking steps to help prevent outsiders from capitalizing on their hard work. The subject of protecting higher education travelers from exploitative foreign interests demands broader discussion and timely address.

The Changing Landscape of Alternative Funding for Student Health Insurance Plans
Historically, the majority of Colleges and Universities that have sponsored a Student Health Insurance Plan (SHIP) have purchased a fully-insured policy through the traditional insurance marketplace, due to the high level of competition through bid pricing. This marketplace has continued to retrench, as a result of increased State and Federal compliance regulations. Within the current Affordable Care Act (ACA) insurance environment, conventional options are being negatively impacted by the rising cost of health insurance, along with the enactment of ACA coverage mandates and associated ACA fees/taxes. These mandates and fees have many institutions (employers) exploring the possibility of various self-insuring methods, in order to maintain a comprehensive SHIP at the most affordable rate. The Employee Retirement Income Security Act (ERISA), a Federal Act, provides employers the ability to self-fund their employer-sponsored health benefit plan, regardless of their size or state. Since students are not employees of the University, SHIPs are not afforded the ability to self-fund at the Federal level (as governed by ERISA). Instead, the ability to self-fund student health is regulated at the State level. A number of states have created legislation that provides for self-funding, in some cases specifically restricting self-funding, while others do not provide commentary/guidance either way. This session will detail considerations made by two major Universities and their consultants, as they have investigated the possibility of self-funding their SHIP, in cases where the domiciled state allowed it, and an alternative method for cases where the state did not provide a clear path to do so.

As a result of participating in this session, attendees will gain an overview of the insurance marketplace and pricing within the Affordable Care Act (ACA) environment, understand the fiduciary and administrative benefits of self-funding health/accident plans, and learn how a captive insurance company can provide a solution that works for all parties (the University, students, and State Department of Insurance). Attendees will also understand how an institution might evaluate self-funding as an alternative, understand threats and opportunities for all funding options, and understand the Federal certification process to obtain Minimum Essential Coverage (MEC) status.

Electrifying Your Risk Management Program
A well designed website is a good starting point as a means of communicating the presence of Risk Management within your University, identifying your Mission, your organizational structure and scope of operations. This will be of significant value in creating visibility within the University Community, and providing members of the University Community with a range of tools and resources that facilitate their success in accomplishing their educational objectives. During this session, we will introduce various electronic tools that can facilitate the work of Risk Management, reducing the burden of faculty and staff in communicating information and requests for assistance to Risk Management. This would begin with a well-designed departmental website and other opportunities to communicate with the University Community, such as Risk Management blogs, and the use of social media, including tools such as Facebook and Twitter. Examples of beneficial tools include electronic waiver forms, Certificate of Insurance tracking systems and/or database, Authorized Driver program management (including DMV data collection), university vehicle management/tracking system, including vehicle maintenance register/software, incident reporting and claims management systems, contract management/routing systems, education and training request form and implementation of electronic systems to deliver training, Enterprise Risk Management (ERM) software for facilitating a successful ERM program. A related goal is to facilitate the generation of quantitative data that documents the scope and volume of work of the department, generally a necessary pre-condition to securing needed ongoing and special funding requests from upper management. The objective of this presentation is not to provide detailed information, but to create awareness, and to begin to develop resource lists that can support the needs of the URMIA membership.

The (Big) Long and the (Big) Short of Insurance Coverage in the 21st Century
Discussion by Pennsylvania State University risk management underwriting and claims handling personnel, complimented by the views of experienced outside insurance coverage counsel of current topics in the University insurance coverage arena. This session will address new insurance policy forms and challenges when underwriting for new risks in the 21st Century deriving from human, natural and cyber disasters. Lessons Learned and Trends Arising from Claims Brought by Students Accused of Sexual Assault
This proposed presentation will provide URMIA conference attendees an overview of the types of claims most frequently brought against institutions of higher education by students accused of committing sexual assault. Presenters Hillary Pettegrew (Senior Risk Management Counsel, United Educators), Joshua W.B. Crises in Study Abroad: Preparation and Response
Is your institution prepared for a crisis abroad? Risk management counsel from United Educators will present the results of a ten year claims study, outlining the most common incidents that occur to students studying abroad with UE member institutions. The study found that some institutions are better than others at responding to crises that involve sexual assault, recreational activities, alcohol, transportation, and health emergencies. Not surprisingly, several claims showed the value of hosting pre-departure risk orientations for students, faculty, and staff. Next, the director of emergency preparedness and risk management from Gonzaga University will discuss how study abroad protocols are developed in conjunction with Gonzaga's study abroad director. The importance of training and orientation sessions, and how those sessions are conducted, will be highlighted. Finally, the co-presenters will lead tabletop exercises based on three of the most common incidents that occur on study abroad programs: sexual assault, student fatality, and health emergency. The goal of these exercises will be to engage the audience in examining their own crisis response protocols, identifying gaps, and taking new ideas back to campus.

As a result of participating in this session, attendees will identify current trends in study abroad incidents. Also, attendees will understand the importance of preparing for a crisis abroad, including; preventing and mitigating incidents through development of protocols, training and orientation sessions, responding to study abroad crises based on the institution’s crisis response protocol, identifying gaps within an institution’s crisis response plan that make it less than effective, addressing training needs for campus constituencies based on the tabletop scenarios, determining the effectiveness of the institution’s vetting process for third-party providers, and practicing an institution’s ability to provide timely and accurate information to different audiences.

Intellectual Property Considerations for the Non-Research University (NACUA Partnered Session)
Intellectual property issues that non-research based universities face are different, and in some cases, more straight-forward than those faced by research institutions. The session provides lessons learned from the campus shooting at Umpqua Community College (UCC) and how fast action and mutual-aid between the University of Oregon, Lane Community College and UCC assisted the campus in response to and recovery from the tragedy. The session will focus on what every campus needs to know when faced with campus trauma and an event that overwhelms your institution’s resources. We will focus special attention on recovery—what it takes to restart a college after a traumatic event and regain momentum and commitment to student success, completion, and equity. This session will include: determining the need for an incident commander or incident management team; identifying national experts on public campus safety; managing intense national and international media presence; and utilizing community relationships and support productively. The California State University, comprised of 23 campuses, initiated and remains in the process of refining a system-wide approach to managing the risk of minors on campus. As part of this process, CSU partnered with Praesidium, a national leader in abuse risk management. This session is designed to provide a collaborative opportunity for attendees to explore the importance of a holistic approach to managing this risk and some of the uninsurable consequences of loss. Cyber2016: Emerging Threats and Challenges, the Evolution of Insurance Coverage, and Best Practices for Security and Defense
Colleges and universities, both large and small, make attractive targets for cyber criminals and vandals. That is because colleges store a wealth of personal information about students, employees and alumni, and because, by their very nature, institutions of higher education are open and collaborative in both the physical and cyber worlds. While the risks are known in a general sense, determining how to best defend against these risks and what (and how much) cyber insurance to purchase remain challenges. HEOA - Assessing Your Institution's Title IV Risks
The Higher Education Opportunity Act (HEOA) is a grab-bag of regulations dating back to 1965, with multiple updates and changes. "What's required" is lengthy and complex. This presentation will provide an overview of the regulations with a focus on how Risk Managers can support their institution by leading a self assessment using guides and checklists already available. Risk Managers do not need to be an expert in Title IV or the HEOA, but to know generally what is included in the regulations, who on their campus is responsible, and most importantly, where there are shared responsibilities. Organizational Culture: Assessing and Resetting for Enterprise Risk Management
Among the tenets of enterprise risk management is the need to instill a culture of risk sensitivity and the shared responsibility for risk management throughout the firm. But risk management is a department or a practice, and the techniques of risk management do not include changing corporate culture. Changing behavior without changing culture may result in compliance without adoption. Changing culture embeds a new practice into an organization so it becomes part of the shared assumptions and decision premises of the employees. The fields of organizational studies, business anthropology and sociology have much insight into corporate culture, and how to embed practices so they become shared assumptions and decision premises that are transmitted through values and stories. This program will discuss the techniques of those disciplines to understand and classify existing organizational culture, and to work with and modify that culture to embed ERM.
As a result of participating in this session, attendees will apply techniques and frameworks to identify corporate cultures, classify corporate cultures, unfreeze and re-freeze corporate cultures to embed new practices and values, and use stories, rituals and artifacts to instill culture.

From Zero To ERM In Less Than 2 Years
In this presentation, we will chronicle the development of an Enterprise Risk Management (ERM) program from concept to full functionality. We will discuss the catalyst event that prompted the Board mandate to manage risks at an enterprise level at the University. We will also discuss lessons learned, obstacles faced and successes attained in the creation of the program in record time. This presentation will be of benefit to freshmen risk managers who may feel overwhelmed when starting an ERM program from scratch or even utilizing an existing framework. Attendees will gain confidence about how to implement a successful program as they learn from our mistakes, discover what resources we had (and didn’t have), and who to “get on your side.” The relevance of this presentation is that many Universities are moving into “enterprise” risk management from traditional risk management. This presentation will show the process of immersion into ERM without an existing framework in place.

As a result of participating in this session, attendees will gain insight on how we overcame obstacles faced and our plans for weaving a culture of risk management in a campus where two years ago, the concept of enterprise risk management was unheard of. We will also show how we utilized the disciplines of qualitative research and marketing management to create a thorough program and communicate its existence to the different university constituencies. Attendees will learn that heading up an ERM program is not as overwhelming as it sounds. They will realize that it is very doable and actually really fun too! It takes work, but if you just have a dedicated team (even if it is a team of two) and you put your heads together then it is possible!

The Changing Marijuana Culture
The marijuana culture is undergoing significant change and more jurisdictions seem to be considering the recreational legalization efforts of pioneer states like Colorado, Washington, Oregon and Alaska. Several other states are also considering the legalization for medicinal use only. The clash of local lenience and federal law persists, as marijuana remains a Schedule I controlled substance despite its availability in retail stores as an edible and an inhaled commodity. A controversy exists between the states, as litigation over the costs of marijuana availability is pending before the U.S. Supreme Court. Zoning, transportation, law enforcement, human services and higher education are sure to feel the impact of this sea of change. A frank discussion of such developments seems essential to prudent risk management. This session will strive to impart current information on the scope of the marijuana economy throughout this country, the legal controversies being fueled by the subject and the ethical dilemmas posed by the trade for professional counselors and advisors in multiple fields.

As a result of participating in this session, attendees will become aware of how potential changes in marijuana legalization can affect housing and other on campus facilities. Attendees will be alerted to the risks that can arise when a university is located in a state where marijuana is illegal, but their students can easily access a state where recreational use is legal and lastly attendees will learn how students in the states where marijuana is legal are forming groups to improve the growth of marijuana plants and revive the public use vote in many other states.

Because educational institutions have campus police and security, they are caught up in the national discussion following the events that gave rise to the Black Lives Matter movement. Security Risk Management (SRM): A Model for Reducing Risk in Education Abroad
The session will address the question, "What can risk managers at universities who are responsible for international student travel learn from other industries that have significant experience with international safety, security and risk management?" It explores use of the Security Risk Management (SRM) Model, developed by the United Nations in 2004 to improve risk assessment, which has been adopted by humanitarian organizations to help promote the safety and security of international staff and travelers. The proposed session will offer insight into how colleges and universities with education abroad programs can benefit from an existing risk management model to better inform decisions about where students are allowed to travel and what recommended procedures travelers should follow. Universities may be unsure how to conduct security risk assessments for locations with existing or proposed education abroad programs. Risk can be difficult to qualify and quantify when an objective assessment has not been conducted and risk assessment committees must rely on potentially biased, outdated or third party information. As a result, recommendations to approve programs in riskier locations, particularly in cases of long-standing programs where health, safety and security risks within the host country have changed, or in newly proposed programs, are sometimes made in an ad hoc or subjective way. Decision-making bodies often rely on a priori assumptions, the United States Government, or advice from program leaders with personal ties to the location and a clear stake in the outcome of the decision. The SRM Model may help universities overcome these challenges. Effective risk assessment involves understanding an institution's acceptable risk threshold, and the ability to use an objective measurement tool to evaluate the threats to and vulnerability of students and faculty at any given location. Participants will learn to use the Security Risk Assessment (SRA) form and to plot the results of their analysis on a Risk Rating Matrix (RRM), which will allow them to proactively provide the essential information to committees and university leadership to keep study abroad programs within the acceptable risk threshold. The session will open with a discussion of key terms relating to assessing international health, safety and security, as well as examples of why the SRM model was developed and how it is being used by many organizations working internationally to reduce risk exposure. After an interactive 20 minute session, the participants will break into working groups of 8 - 10 people each to conduct a risk assessment for a hypothetical program. Depending on the number of participants in the session each working group will then present their findings to the larger group, which will be plotted on a Risk Rating Matrix for all to see, and discussed within the plenary. The session will close with Q & A.
As a result of participating in this session, attendees will be able to define key terms, become familiar with key concepts of Security Risk Management Model (SRM), and learn about the acceptable risk threshold and how and why SRM is used by those responsible for traveler safety and security at the United Nations and within international humanitarian organizations. Participants will be trained to assess potential education abroad locations and proposed activities for the potential impact on student health, safety, and security, including safety and security procedures based on assessment outcomes

General Session: Student Safety During Political Upheaval
In January 2011, University of Pennsylvania Ph.D. student Eric Trager was conducting dissertation research on Egyptian opposition parties in Cairo when the “Arab Spring” uprising erupted suddenly. Within days, the Egyptian government cut almost all Internet access and suspended cell phone service for twenty-four hours, while security forces blanketed downtown Cairo with teargas, forcing Eric to navigate a rapidly shifting and increasingly unstable environment. In this session, Eric will discuss the safety lessons he learned during the uprising’s early days, and also explain the safety precautions that he has taken during his subsequent research in the Middle East, where security conditions are constantly in flux.

Drones: An Update on the 2016 FAA Regulations and How this Affects Your Institution
The presentation will provide an overview of the updated FAA regulations and how this impacts the use of Unmanned Aerial Systems in education, research, and institutional operations. Will include information on registration requirements, the control environment and liability concerns for institutional UAS use and for student and public use on/over campus property. Campus Risk Policy examples for operations of drones will be provided.

Implementing a Safety Culture (APLU/AAU Partnered Session)
In their Guide to Implementing a Safety Culture in Our Universities, the Task Force on Laboratory Safety called on the Association of Public and Land-grant Universities (APLU) and the Association of American Universities (AAU) to ask the presidents and chancellors of all academic institutions to renew their commitment to improve the safety culture for all academic research, scholarship, and teaching. The Task Force, convened by APLU’s Council on Research, and in coordination with AAU, the American Chemical Society, and Council on Governmental Relations (COGR), provided 20 recommendations drawn from reports from the National Academies, ACS, OSHA, and the US Chemical Safety and Hazards Board. The Guide also has a toolkit for strengthening a culture of safety. We will share highlights from this guide, and then introduce a panel of risk managers to share their universities’ efforts in strengthening a culture of safety.

Managing the Risks & Liabilities of Research Center Activities
Many colleges and universities have developed research centers to advance the work being conducted by their faculty and staff. While these centers offer tremendous opportunities, they do create risks that must be identified and managed to protect the interests of the institution and the faculty. This session will focus on the risks and liabilities created by the operation of a research center and the activities taking place within these centers. Legal issues to be addressed include patent protection, copyright infringement, the Fair Labor Standards Act, and ensuring that all research is conducted in an appropriate manner. Operational issues to be addressed include protection of the property, ensuring the safety and well-being of students and minors, and a myriad of landlord-tenant matters. Participants will learn about many of the risks associated with the ownership or operation of a research center, how to proactively identify these risks, and how to then effectively manage these issues. This will include a risk identification process, working successfully with the affected campus community, and accessing the information and expertise necessary to support your efforts in this environment.
As a result of participating in this session, attendees will identify the numerous legal and operational risks associated with the ownership and operation of a research park or research center.

Counting the Last Dollar?: Institutional Finance Survival Skills for Fun and (Non)Profit
College and universities are complicated financial machines. With so many under financial strain in recent years, and with talk of mergers and some closures, what are the predictive factors that can be applied to institutional finances to determine survivability? Come learn, in a light-hearted style, how to read higher ed financial statements, focusing in on the handful of truly critical line items and what they mean. We will present both commonly used and proposed simplified predictive formulas for estimating an institution's financial health, and will give the audience the opportunity to vote "thumbs-up" or "thumbs-down" on the chances of (anonymous!) institutions surviving, based on the available financial information. We will discuss how risk management decisions, such as selection of deductibles or SIRS, can affect deeper issues such as cash flow and bond ratings, and how to make good operational decisions on behalf of institutional finances.

As a result of participating in this session, attendees will understand which are the basic financial statements and ratios used in higher education and what they mean, learn more about how to "talk finance" language for administrative or board reports, and lastly, learn how to identify line items on a financial statements and other trends that are critical to an institution's health.

We Believe in Free Speech, But: The Enterprise Risk Management of First Amendment and Academic Freedom Issues
This presentation (a lecture followed by a multi-disciplinary panel discussion) will discuss the enterprise “constitutional risk” associated with claims based on the First Amendment and Academic Freedom, which is a “special concern” of the First Amendment. Specifically, the focus will be on individual student speech including social media, recognition and funding of student groups, faculty speech both inside and outside the university, demonstrations and protests, and the institution’s ability to engage in government speech. The lecture by an institutional General Counsel will present an overview of the constitutional issues and measures to reduce and manage the enterprise risk. The panel discussion will involve institutional risk managers, an institutional public relations director, and a representative of Marsh.

As a result of participating in this session, attendees will learn how the First Amendment and the “special concern” of academic freedom limit the discretion of public institutions. Specifically, the focus will be on individual student speech including social media, recognition and funding of student groups, faculty speech both inside and outside the university, demonstrations and protests, and the institution’s ability to engage in government speech. Participants will learn how to identify those policies and practices that are subject to constitutional attack on First Amendment/Academic Freedom grounds and how to minimize enterprise “constitutional risk” by altering policy, engaging in educational programs, or undertaking a dialogue with advocacy groups. Lastly, they will learn how to manage enterprise “constitutional risk” when the plaintiffs sue the institution on a First Amendment or Academic Freedom claims. Management of enterprise constitutional risk for First Amendment and Academic Freedom claims includes retaining counsel, when to settle, the utilization of a public relations strategy, and special concerns related to existential issues (those that the institution can never compromise).

In the introduction to her book “Engaging Risk” Paula Vene Smith notes “For higher education institutions, the “bottom line” is academic mission. The financial wellbeing is vital – but inextricably linked to academic mission”. 2015 found higher education institutions struggling to respond to high profile, enterprise wide challenges and opportunities including campus diversity, adjunct unionization and academic freedom, issues that can impact an institutions ability to carry out its academic mission. Join our panelists as they explore these issues and work through a group ERM exercise that identifies risk, assesses severity, assigns possible risk owners and explores mitigation strategies.
